Terms of Service

These Terms govern your access to and use of SIMA MIND (the "App," "Service"), operated by SimaTech ("SimaTech," "we," "us," "our"). By creating an account or using SIMA MIND, you agree to these Terms. If you do not agree, please do not use the Service.

1. Introduction & Acceptance

SIMA MIND is an AI-powered educational study platform providing tools including an AI tutor, adaptive explanations, flashcards, quizzes, study timetables, uploaded-document analysis, audio/video study aids, and study groups. By creating an account, you confirm that you accept these Terms and our Privacy Policy, and that you meet the eligibility requirements below. Eligibility: You must be at least 13 years old to create a SIMA MIND account. By registering, you confirm you meet this requirement. If SimaTech becomes aware that a user is under this minimum age, the account may be suspended or removed.

2. Definitions

"SIMA MIND" — the AI study platform and application described in these Terms. "SimaTech" — the company operating SIMA MIND, powered by SMX (Silent Matrix) and MGX (Marographix). "User"/"you" — any individual who creates an account or otherwise uses SIMA MIND. "Account" — the registered profile associated with a user. "Subscription" — a paid plan (Scholar Lite, Standard, or Scholar) providing access to Premium Features. "Premium Features" — features not available on the free Basic plan. "AI-generated content" — any explanation, answer, quiz, flashcard, summary, or other material produced by SIMA MIND's AI systems.

3. Account Registration

You agree to provide accurate, current information when creating your account (e.g., name, email, education level, course, institution). You're responsible for keeping your login credentials secure and confidential. Accounts are intended for individual use — one person per account, except where SIMA MIND explicitly enables shared or managed access (e.g., a guardian assisting a younger learner). You are responsible for all activity that occurs under your account. Notify us immediately at support@simatech.uk if you suspect unauthorised access.

4. Use of SIMA MIND

Permitted use: Personal, non-commercial educational use of SIMA MIND's features, in accordance with these Terms. Prohibited use — you agree not to: use SIMA MIND for any unlawful purpose or in violation of any applicable law; attempt to hack, scrape, reverse-engineer, decompile, or extract SIMA MIND's underlying models, prompts, source code, or architecture; circumvent usage limits, security features, or subscription restrictions; upload malicious files, viruses, or harmful code; use SIMA MIND to generate content that is illegal, harassing, hateful, or infringes on others' rights; resell, sublicense, or commercially exploit SIMA MIND's outputs or infrastructure without written permission; impersonate another person or misrepresent your identity, education level, or institution. Violation of this section may result in suspension or termination of your account (see Section 17).

5. AI Services

SIMA MIND's core functionality relies on artificial intelligence. By using the Service, you understand and accept that: AI responses are generated automatically, based on patterns in data and the information you provide or upload; AI can make mistakes, produce incomplete answers, or misinterpret context; content is not guaranteed to be accurate, complete, or up to date; you are responsible for independently verifying important information before relying on it, especially for exams, assessments, or real-world decisions; SIMA MIND is not a substitute for qualified teachers, lecturers, exam authorities, healthcare professionals, legal professionals, or authoritative textbooks and institutional resources.

6. Educational & Medical Disclaimer

SIMA MIND is an educational technology platform. It is not a medical diagnosis, treatment, or clinical decision-making service, and it is not a substitute for legal advice. Information provided by SIMA MIND, including AI-generated content, should never be relied upon as a substitute for professional medical advice, institutional clinical guidelines, licensed instruction, qualified legal counsel, or authoritative medical, legal, and academic resources. If you have a medical concern, seek care from a qualified healthcare professional. This is especially important for users studying medicine and using SIMA MIND for clinical rotation preparation — SIMA MIND does not replace supervised clinical training or institutional protocols.

7. Free and Premium Services

SIMA MIND currently offers four tiers: Basic (free), Scholar Lite, Standard, and Scholar. Each tier includes different limits and features covering AI messages, file uploads, flashcards, MCQ generation, exam practice mode, audio/video studio tools, group study, clinical tools, and AI response quality. Full current details are available on the Pricing page. Features, limits, and tier names may change over time as SIMA MIND develops. We'll aim to communicate material changes to paid features in advance where reasonably possible. A 14-day free trial of premium features is provided automatically to every new account, starting from the date of account creation.

8. Subscriptions

Price: Displayed in the app in Zambian Kwacha (ZMW) and US Dollars (USD) at the time of purchase. Prices may change from time to time; the price shown to you at checkout is what applies to your purchase. Billing period: Subscriptions currently bill monthly. Annual billing may be introduced in future. Automatic renewal: Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Cancellation: You may cancel at any time from your account settings, or via Google Play if purchased there. Cancelling stops future renewals; you retain access to Premium Features until the end of your current paid period. After cancellation: Your account reverts to the Basic (free) tier at the end of the paid period. Previously generated content (e.g., flashcards, saved notes) remains accessible subject to any storage limits of the Basic tier. Where subscriptions are purchased through Google Play, Google's own subscription terms and policies also apply, and nothing in these Terms overrides Google's requirements around pricing transparency, renewal disclosure, and cancellation.

9. Payments

Payments made directly through SIMA MIND are processed via Flutterwave, supporting bank cards, bank transfers, and mobile money (including Airtel Money, MTN Money, and Zamtel Money), depending on availability in your region. Payments made through the Google Play Store are processed via Google Play Billing. You are responsible for any applicable taxes associated with your purchase. If a payment fails (e.g., insufficient funds, expired card, network issue), your access to Premium Features may be paused until payment is successfully completed.

10. Refunds

Refunds are governed by our separate Refund & Cancellation Policy. Refund eligibility is also subject to Google Play's own refund rules (where purchased via Google Play) and any applicable consumer protection law in your jurisdiction.

11. Intellectual Property

All SIMA MIND branding, logos, user interface, software, original educational material, and the underlying AI prompts and architecture are the property of SimaTech (and its underlying SMX/MGX teams) or its licensors, and are protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of SIMA MIND's technology, branding, or original content — only a limited licence to use the Service as intended.

12. User Content

"User Content" includes notes, documents, questions, uploaded files (PDFs, PPTs, DOCX, images), and any other material you submit to SIMA MIND. You retain ownership of your User Content. By uploading it, you grant SimaTech a limited licence to store, process, and use it solely to provide and improve the Service for you (e.g., generating flashcards or summaries from your own uploads). You are responsible for ensuring you have the right to upload and use any content you submit.

13. Copyright Infringement

Do not upload or distribute material you don't have the right to use or share. If you believe content on SIMA MIND infringes your copyright, contact support@simatech.uk with details of the material and your rights in it, and we will review and, where appropriate, remove the material.

14. Privacy

Our collection, use, and storage of your personal data is described in our Privacy Policy, which forms part of these Terms by reference.

15. Third-Party Services

SIMA MIND relies on third-party services to operate, including (without limitation): Google Play (distribution and billing), third-party cloud hosting and infrastructure providers (data storage and AI hosting), Flutterwave (payment processing), and analytics or authentication providers as applicable. Your use of SIMA MIND may be subject to those providers' own terms where you interact with them directly (e.g., Google Play's terms when purchasing via the Play Store).

16. Service Availability

We aim to keep SIMA MIND available and reliable, but we do not guarantee uninterrupted access. The Service may be affected by maintenance, updates, bugs, or outages of third-party providers we rely on. We are not liable for temporary unavailability of the Service.

17. Account Suspension / Termination

We may suspend or terminate your account, with or without notice, if we reasonably believe you have: violated these Terms; engaged in fraud or payment abuse; attempted to hack, scrape, or reverse-engineer the Service; engaged in illegal activity through the Service; repeatedly or seriously violated these Terms after being warned.

18. Effect of Termination

Upon termination or account closure: your access to the Service ends; any active subscription is cancelled (refunds, if any, are handled per our Refund & Cancellation Policy); and your data is handled according to our Privacy Policy, including applicable retention and deletion timelines.

19. Disclaimers

SIMA MIND is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties regarding: the accuracy or completeness of AI-generated content; specific educational outcomes, grades, or exam results; and uninterrupted or error-free service availability.

20. Limitation of Liability

To the fullest extent permitted by applicable law, SimaTech's total liability arising out of or relating to your use of SIMA MIND shall not exceed the amount you paid to SimaTech in the twelve (12) months preceding the claim. SimaTech is not liable for indirect, incidental, or consequential damages, including loss of academic results, arising from use of the Service. Nothing in these Terms limits liability that cannot be excluded under applicable law.

21. Indemnification

Where legally permitted, you agree to indemnify and hold SimaTech harmless from claims arising out of your violation of these Terms or misuse of the Service.

22. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or via the email associated with your account where reasonably possible, along with an updated "Last updated" date. Continued use of SIMA MIND after changes take effect constitutes acceptance of the revised Terms.

23. Governing Law & Disputes

SIMA MIND is used internationally, including across Southern Africa and the United Kingdom. Where mandatory consumer protection laws of your country of residence apply to your use of the Service, those laws will govern to the extent required. Subject to that, these Terms are governed by the laws of Zambia, without regard to conflict-of-law principles. Any dispute not otherwise resolved informally will be subject to the appropriate courts having jurisdiction over the parties.
